2. الصلاحية
بواسطة مشاركة عملك معنا باستخدام أي من الطرق الموضحة في المادة 1 ، فإنك تؤكد أنك:
- شخص طبيعي بلغ السن القانونية ؛
- المستخدم أو المالك أو المستأجر أو أي ملكية أخرى تخولك تفويض النقل ؛ و،
- المؤلف الأصلي ومالك العمل الذي شاركته.
3. منح الترخيص
بواسطة مشاركة عملك معنا باستخدام أي من الطرق الموضحة في المادة 1، فإنك توافق على هذه الشروط والأحكام وتمنح vidaXL ترخيصًا:
- مجانيًا، مع التنازل عن أي حق في الحصول على تعويض ؛
- غير حصري، مما يسمح لك باستخدام العمل وترخيصه في مكان آخر ؛
- غير مقيد إقليميًا، ساري في جميع أنحاء العالم ؛
- دائم، مستمر إلى أجل غير مسمى حتى سحب الموافقة (انظر الجزء 7 )؛
- قابل للتحويل وقابل للترخيص من الباطن، مما يمكّن vidaXL من التصريح باستخدامه بواسطة أطراف ثالثة.
يسمح الترخيص لـ vidaXL بما يلي:
a) خدام العمل وإعادة إنتاجه وتوزيعه ونشره علنًا وتنفيذه وعرضه علنًا على مواقعنا الإلكترونية وحساباتنا ووسائل الإعلام الأخرى، بما في ذلك النشرات الإخبارية والمواد المطبوعة ؛
b) تفويض الآخرين لأداء الأنشطة المذكورة أعلاه نيابة عن vidaXL ؛
c) تعديل وتحرير وترجمة وتخزين وإنشاء أعمال مشتقة من العمل دون موافقة أخرى. ٧لة
تشمل الاستخدامات التي قد تتم مشاركة عملك معها والأطراف الثالثة: وسائل التواصل الاجتماعي (من بينها Instagram و Facebook و Twitter و Pinterest و TikTok)، والأطراف الثالثة الإعلانية (Google adds، ووكالات الإعلان، وما إلى ذلك)، وقنوات مبيعات الأطراف الثالثة (Amazon eBay، وما إلى ذلك)، والمحلات الفعلية، ونشرتنا الإخبارية أو الإعلانات المطبوعة على المجلدات.
4. حقوق الطرف الثالث
ستتخذ vidaXL إجراءات معقولة لمعالجة أي انتهاكات لحقوق الطبع والنشر أو الملكية إذا تم الإبلاغ عنها. ومع ذلك، بواسطة مشاركة عملك معنا باستخدام أي من الطرق الموضحة في المادة 1، فإنك تؤكد أن العمل لا ينتهك أي حقوق لطرف ثالث، بما في ذلك حقوق الشخصية أو الخصوصية. نطلب منك الامتناع عن تقديم صور تحتوي على أفراد لأنه لن يتم استخدام أي عمل من هذا القبيل. ومع ذلك، لن تتحمل vidaXL المسؤولية عن أي خرق للضمانات المقدمة بموجب القسم 2 إلى 4.
5. البيانات الشخصية وسحب الموافقة

6. نسب عملك

7. سحب الموافقة وإزالة المحتوى

8. حقوق الملكية الفكرية
أنت تقر بأن موقع vidaXL وحسابات وسائل التواصل الاجتماعي والعلامات التجارية والشعارات محمية بموجب قانون الملكية الفكرية. لا تمنحك هذه الاتفاقية أي حقوق على الملكية الفكرية لـ vidaXL.
9. التعديلات والقانون الحاكم:
يجب أن تكون أي تعديلات على هذه الاتفاقية مكتوبة أو إلكترونية. في حالة اعتبار أي حكم غير صالح، ستظل الأحكام المتبقية سارية المفعول. تخضع هذه الاتفاقية لقوانين هولندا.

Terms and Conditions for content sharing

We really love seeing our products being used by our customers and would like to be able to share this on our websites, social media accounts or other forms (hereinafter referred to as “Accounts”). To do this, we need you! You have been transferred here because we really like your content and we (vidaXL and its affiliate companies (hereinafter ‘vidaXL’)) noticed you used one of the following content sharing options to provide consent for vidaXL to use the content (hereinafter referred to as “Work”).
We would like to share your Work on our websites, Accounts or otherwise as explained herein. To this end, we are obtaining your explicit consent to make use of the requested Work as follows:
1. Ways to share content with us
There are three ways for you to share content with us:

2. Eligibility
By sharing your Work with us using any of the methods described in article 1 of the present, you confirm that you are:
- A natural person of legal age;
- The user, owner, tenant or any other title that entitles you to authorize the transfer; and,
- The original author and owner of the work you have shared.
3. License Grant
By sharing your Work with us using any of the methods described in article 1 of the present, , you agree to these Terms and Conditions and grant vidaXL a license that is:
- Free of charge, waiving any right to receive compensation;
- Non-exclusive, allowing you to use and license the Work elsewhere;
- Territorially unrestricted, applying worldwide;
- Perpetual, lasting indefinitely until consent withdrawal (see Part 7);
- Transferable and sublicensable, enabling vidaXL to authorize use by third parties.
The license allows vidaXL to:
a) Use, reproduce, distribute, publicly display, publicly perform and exhibit the Work on our websites, Accounts, and other media, including newsletters and print material;
b) Authorize others to perform the above activities on behalf of vidaXL;
c) Modify, edit, translate, store and create derivative works of the Work without further consent.
Uses for which and third parties with whom your Work may be shared include: social media (amongst which are Instagram, Facebook, Twitter, Pinterest and TikTok), advertising third parties (Google adds, agencies for advertising, etc.), third party sales channels (Amazon eBay, etc.), brick-and mortar shops, our newsletter or as printed advertising on folders.
4. Third-Party Rights and liability
vidaXL will take reasonable action to address any copyright or rights violations if reported. However, by sharing your Work with us using any of the methods described in article 1 of the present, you confirm that the Work does not breach any third-party rights, including personality or privacy rights. We kindly request that you refrain from submitting pictures depicting individuals as any such Work will not be used. vidaXL will, however, not be held liable for any breach of the assurances provided under Section 2 to 4.
5. Personal data and consent withdrawal
For crediting purposes, we may process personal data such as your username on the platform from which you use the hashtag and published the Work. In exceptional cases, additional data (e.g., your email or other data provided to us) may be processed. You retain the right to:
- Request access, rectification, or deletion of your personal data;
- Withdraw consent at any time as specified in section 7 below.

6. Credit for your work
Where possible, we will credit your Work by tagging your username or mentioning your name. However, specific formats or placement cannot be guaranteed.
7. Consent withdrawal and content removal
If you choose to withdraw your consent, notify us by sending an email to social.media@vidaXL.com. Upon withdrawal, vidaXL will cease using your Work for the future from receipt of your request or at least within 30 days from your request. Content already published will be removed unless impossible or unreasonable (examples include printed out material from past promotions).
8. Intellectual Property Rights
You acknowledge that the vidaXL site, social media accounts, trademarks, and logos are protected by intellectual property law. This agreement does not grant you any rights over vidaXL’s intellectual property.
9. Amendments and governing law
Any amendments to this agreement must be in written or electronic form. Should any provision be deemed invalid, the remaining provisions will remain effective. This agreement is governed by the laws of the Netherlands.
